CECA South West – Service Strike Mock Trial with DAC Beachcroft

There are over 60,000 cable strikes every year with electricity causing the most significant injuries. Significant fines can be imposed if a cable strike leads to a successful prosecution.

But what happens if a company gets all of those things right? What happens if there is still a cable strike despite a company’s best efforts? When will HSE focus its attention on individuals?

This mock trial concerns the prosecution of an individual employee who is alleged to have failed to take reasonable care of his colleagues’ safety by reason of his acts and omissions.

Delegates will hear evidence about the company’s procedures and training – but which the employee concerned did not follow.

Delegates will see how the HSE prosecutes and the allegations of how the employee did not take reasonable care – not just for his or her own health and safety – but for the health and safety of those who may be affected by his or her acts or omissions.

This trial is based partly on a real prosecution and partly on real-life examples of employees taking shortcuts with employer’s procedures. Not all shortcuts are meant maliciously or foolishly, but all can have devastating consequences. This trial is intended to demonstrate to delegates the importance of following instructions, training and procedures and what can happen if they do not.

The ‘trial’ is a snapshot of a Crown Court or Sheriff Court hearing. Delegates will see an opening speech for the Defendant. A judge will then sum up the evidence and delegates will be asked to play the role of the Jury – determining not just guilt but also sentence.

At the end of the session, delegates will have a better understanding of the relevant law for each offence being tried and the difficulties that juries may experience in convicting an organisation or individual.

This is an innovative and engaging session lead by DAC Beachcroft Claims Ltd.

The mock trial will take place on Tuesday 28 June 2022 at Sandy Park, Exeter and is aimed at operational people at all levels.

The event will start at 0930 and finish at approximately 1330 when lunch will be provided and is free to member companies.
